The High Court has redefined cruelty in marriage. It’s not only about beatings, it includes emotional neglect, cold silence, denial of intimacy and living like strangers under one roof. A marriage without love, affection, and companionship is not a marriage at all.
In JKS v JGI, the Court said forcing people to stay where love has died is injustice. Marriage must be chosen every day, not endured like a prison sentence. Kenya’s divorce law has officially shifted, duty alone can’t save a dead relationship.
