The impeachment of HE.Rigathi Gachagua should be reversed, as it has become clear that Parliament has been operating in violation of the Constitution. According to a ruling by a bench of three High Court judges, the Kenya Kwanza coalition does not hold a majority. This undermines the legitimacy of the entire Parliament’s actions.
Speaker Moses Wetang’ula’s position is compromised, as he continues to hold the leadership of Ford Kenya, and Kimani Ichung’wa’s role as Majority Leader is similarly unlawful. As a result, every decision made by Parliament in the past, including the vetting of Cabinet Secretaries and the passing of key laws such as the Social Health Agenda (SHA) and the Housing Levy, should be considered null and void.
Furthermore, the Deputy President, Kithure Kindiki, holds his office illegitimately, and all actions taken under this flawed Parliament should be declared invalid. Given the unconstitutional foundation of this parliamentary system, it is only fitting that Parliament be dissolved, forcing MPs to return home to restore the integrity of our democratic processes.
