
Impeached Dp Rigathi Gachagua now wants to change his petition in court and ask for money instead of being given back his job as the deputy president.
He says his removal from office was not lawful and he should be paid what he would have earned if he had completed his full term of five years.
Gachagua, through his lawyer Paul Muite, told the court that he no longer wants to go back to office and has dropped that request. His new plan is to get financial compensation for the time he missed in office.
Lawyer Paul Muite explained to the judge that they want to change the earlier prayers in the petition and replace them with a request for payment.
He made it clear that Gachagua is not interested in making any other legal requests in the meantime and asked the court to give them the earliest possible date to hear the new petition.
Muite also told the court that the case is not about the public but is a private matter between Gachagua and those who removed him from office.
The people being taken to court did not oppose Gachagua’s request to change his petition. This means the court is now expected to consider his application for damages without dealing with the issue of reinstatement.
Gachagua’s move shows he has accepted that he will not return to office but still wants to be paid for the time he lost due to what he claims was an illegal process.
The next step will be for the court to decide whether his new petition will go forward and whether he deserves the money he is asking for.
