BREAKING: Donald Trump gets slammed with the first major lawsuit over his disastrous “Liberation Day” tariffs as a libertarian group unloads a devastating legal barrage alleging that he overextended his presidential authority.
This is the first big one but the legal dam is about to burst…
“Our system is not set up so that one person in the system can have the power to impose taxes across the world economy. That’s not how our constitutional republic works,” stated Jeffrey Schwab, senior counsel at Liberty Justice Center, the organization leading the lawsuit.
“And so that is the thing that we’re very concerned about. Because today it’s tariffs, but could it be something else in the future,” Schwab added.
The Liberty Justice Center is a public-interest firm that often represents right-wing causes, proving that even conservatives are starting to turn on Trump’s failed presidency. The lawsuit was filed in partnership with Professor Ilya Somin of George Mason University’s Antonin Scalia Law School.
“If starting the biggest trade war since the Great Depression based on a law that doesn’t even mention tariffs is not an unconstitutional usurpation of legislative power, I don’t know what is,” stated Professor Somin.
Trump’s so-called “reciprocal” tariffs were outlandishly high and sent the global economy into a tailspin while the U.S. stock market plummeted. Trump later backtracked and reduced the tariffs to 10% on most countries, with the exception of China which he is still hammering with new tariffs.
The new lawsuit challenges Trump’s supposed ability to impose tariffs unilaterally under the International Emergency Economic Powers Act of 1977, which is supposed to be used for battling an “unusual and extraordinary threat.” It has never been exploited in this manner before.
The suit was filed on behalf of five small businesses that have been harmed by the harebrained tariffs, representing just a small sampling of the American companies that are being crushed by Trump’s policies. They include a wine and spirits company, a sports e-commerce company, an electric toy designer, a pipe maker, and a woman’s cycling apparel brand.
